Bangalore: Karnataka High Court (Karnataka High Court) quashed a sessions court’s order awarding life imprisonment to a woman from Andhra Pradesh for the murder of her two-month-old daughter and ordered her release from jail.
Madhugiri, Additional District and Sessions Judge of Tumakuru district, on July 22, 2017 sentenced Kavita of Madakasira of Sri Sathyasai district of Andhra Pradesh to life imprisonment for murder under Section 302 of the Indian Penal Code.
Kavita and her husband Manjunath had come to a hospital in Koratagere, Tumakuru, Karnataka to treat their baby girl suffering from respiratory problems and epilepsy. Kavita was unable to even feed her baby milk.
The innocent girl was thrown in the river
Manjunath complained to the local police that Kavita had dumped the girl in the Swarnamukhi river on the outskirts of the city on August 24, 2016. After investigation and trial, in 2017 the lower court convicted the woman.

However, earlier this month, a bench of Justice K Somashekar and Justice Shivshankar Amarnavar in the High Court, allowing the woman’s appeal, rejected her conviction and acquitted her.
The bench said that the prosecution evidence should prove that the accused had killed the girl. But, no concrete evidence was provided by the prosecution to ensure the conviction of the accused.
